This English version is a translation provided for your convenience only. In the event of any discrepancy between this translation and the Traditional Chinese version, the Traditional Chinese version shall prevail.

Welcome to the FinLab Quant Platform website (the "Site"). The Site is built by FinLab Ltd. (the "Company") and provides services under these Terms of Service (the "Terms") established by the Company. By using the services of the Site, you acknowledge that you have read, understood, and agree to these Terms, so please read them carefully, including: the Terms of Service, Disclaimer, and Privacy Policy. Any matters not covered herein shall be governed by the relevant laws of the Republic of China (Taiwan).

1. Additions and Amendments to the Terms

If you continue to use the Site after any modification or change to these Terms, you are deemed to have read, understood, and agreed to accept such modification or change. You agree to be bound by the amended Terms from the time they are announced; the Site will not provide individual notice.

2. Protection of Minors

If you are under twenty (20) years of age, you must obtain the consent of your parent or legal guardian before purchasing the Company's services on the Site, and please read these Terms together with your parent or legal guardian. If you are a parent or legal guardian who permits a child to use paid services, you must comply with these Terms and are responsible for your child's activities within those services.

3. User Accounts and Passwords

Each user of the Site must register an account and password, which represent your personal identity on the Site. You undertake never to use the Site for any unlawful purpose or by any unlawful means, and to comply with the relevant laws of the Republic of China and all international conventions for the use of the internet; if you are a user outside the Republic of China, you also agree to comply with the laws of your own country or region. Please note the following:

  1. You may only use one user account and password; please do not register more than once.
  2. A single account may be used on at most three devices or browsers at the same time. If a single account is used on more than three devices or browsers, the Company has the right to suspend use of that account.
  3. You are solely responsible for any opinions or comments you post on the Site; do not impersonate others, post false statements, or engage in any act that violates the law or infringes the rights of others.
  4. Please keep your personal password safe and never disclose or provide it to others; all actions taken after logging in with the same account and password will be deemed the personal actions of the holder of that account and password.
  5. If you discover or suspect that someone has used your account or password without authorization, please change it immediately and notify the Company as soon as possible.
  6. Every user may express different opinions and ideas on any topic. Please respect others and avoid personal attacks or malicious defamation.
  7. For any information you upload or post on the Site that contains another party's trade secrets or intellectual property, please be sure to obtain lawful authorization in advance. If a user infringes intellectual property or related laws on the Site, it is the user's personal unlawful act and the Company bears no legal responsibility.
  8. Do not promote, advertise, or market any commercial organization, product, or service on the Site, or conduct any other commercial activity (for example, selling, brokering, or intending to sell or broker any securities).
  9. Do not upload pornographic, obscene, false, or other content that violates the law or public morals, to avoid criminal liability.
  10. Do not transmit or distribute computer viruses, spam, or other similar unlawful programs.

4. Site Content Is for Reference Only

All information, links, and program analysis tools on the Site are provided solely as an auxiliary reference for you, and do not constitute any advice or implication regarding investment or financial management. Users should exercise prudent judgment when making any specific decision about investment or financial management. All data provided by the Site is subject to officially published data; you are solely responsible for any losses incurred in transactions made in reliance on the Site's information or program tools, so please carefully assess the risks.

5. Protection of Intellectual Property

The software or programs used by the Site and all content on the Site are protected by intellectual property rights held by the Site or other rights holders in accordance with the law.

You may not copy, modify, distribute, sell, or lease any part of the Site's services or software, except with the Site's prior written authorization or where permitted by applicable law. You also may not reverse-engineer, attempt to extract our source code, or integrate the Company's developed APIs (application programming interfaces) for commercial use.

If you wish to cite or reproduce the above content, please obtain the prior written consent of the Site or other rights holders in accordance with the law, and clearly indicate the source thereafter; any violation shall be subject to liability for damages.

6. Site Authority

The Site reserves the right to delete or modify the information you upload or post, or to cancel your eligibility to use the Site, directly and without notice. If you impersonate others, post false statements, or violate the law or public order and morals on the Site, you shall bear all legal responsibility, and the Company will fully assist and cooperate with authorized government agencies in their investigations.

In addition, the Company reserves the right to add, modify, or remove any activity or service provided on the Site, without separate individual notice.

7. Information Posted by Other Users

You should exercise particular caution when reading or using any statements or information on the Site, including the various analyses, opinions, and comments on the forum. Statements or information posted by other users do not represent the statements, opinions, or position of the Site; the Site cannot guarantee their truthfulness, completeness, or credibility, and bears no responsibility for them.

Users other than the Company's official accounts are prohibited from posting any commercial activity (for example, selling, brokering, or intending to sell or broker any securities-related services) on the Site's forum. If you discover such a situation, please do not trust such messages.

8. Paid Services

You may upgrade to a paid membership through a subscription plan. The features, scope of services, and pricing for paid members provided by the Site may be adjusted in line with the Site's development and operations; please refer to the membership subscription page for the latest details.

If you wish to try out features, you may first adopt the "Free Membership Plan" to understand the core features of the Site.

The VIP plan requires a minimum subscription of twelve (12) months; the customer will be automatically charged for the next month on the day after each monthly expiry date.
The AI plan requires a minimum subscription of nine (9) months; the customer will be automatically charged for the next month on the day after each monthly expiry date.
The MAX plan (also known as the AI MAX plan) requires a minimum subscription of six (6) months; the customer will be automatically charged for the next month on the day after each monthly expiry date.

Within the scope permitted by applicable law, payments are non-refundable, and we do not refund unexpired membership periods.

Before the minimum subscription months are met, users may freely switch between the VIP, AI, and MAX plans; each switch constitutes a brand-new subscription, and the minimum subscription months must be recalculated from the beginning.
After the minimum subscription months are met, the paid membership may be cancelled. After cancellation or interruption, paid membership features will automatically expire at the end of the plan cycle, and no charge will be made on the next monthly expiry date. If you resubscribe after cancelling or interrupting, you will no longer enjoy the price and content of the original subscription plan; the service content and price applicable will be those of the latest plan.

In accordance with Article 2, Subparagraph 5 of the "Regulations on Reasonable Exceptions to the Right of Rescission for Distance Sales," the Site's paid membership service is deemed completed once you authorize the charge to purchase it, and the seven-day rescission right for distance sales under Article 19, Paragraph 1 of the Consumer Protection Act does not apply.

9. Suspension, Interruption, or Termination of Service

If the Site makes material changes that negatively affect your use of the service, or if the Site ceases to provide the service, we will give you reasonable advance notice. However, in any of the following circumstances, the Site has the right to suspend, interrupt, or terminate all or part of the service at any time without advance notice, and bears no liability for compensation to users:

  1. When performing emergency fault repairs or upgrade maintenance on the Site's related electronic systems and equipment.
  2. Service stoppage or interruption caused by force majeure such as natural disasters.
  3. Preventing abuse, complying with legal requirements, or handling security and operability issues.
  4. Service stoppage or interruption caused by factors not attributable to the Site.

10. Governing Law and Jurisdiction

The interpretation and application of these Terms of Use, as well as any dispute related to these Terms of Use, shall be governed by the laws of the Republic of China, with the Taiwan Taoyuan District Court as the court of first instance.

This Disclaimer is established by FinLab Ltd. (the "Company") for the FinLab Quant Platform website (the "Site"). The Site strives to provide timely, professional, and accurate information; however, in case of any discrepancy, the data published by the relevant national or regional exchanges, companies, or official authorities shall prevail.

Taiwan stock data is sourced from the Market Observation Post System, the Taiwan Stock Exchange, and the Taipei Exchange. The analytical data, visual charts, and program tools provided by the Site are for reference only and do not imply any buy or sell recommendation. The Site hereby states and warns that any investment carries a high degree of risk; users should carefully assess the risks and bear full responsibility for their investment decisions and trading gains and losses. For any investment behavior taken by users in direct reliance on the relevant information and programs, and any direct or indirect losses or damages and related liabilities incurred thereby, the Site shall not bear any liability for damages or legal responsibility. Welcome to the FinLab Quant Platform (the "Site"). To enable you to use the Site's various services and information with peace of mind, we hereby explain the Site's privacy protection policy to protect your rights. Please read the following carefully:

1. Scope of the Privacy Protection Policy

The privacy protection policy covers how the Site handles the personally identifiable information collected when you use the Site's services. The privacy protection policy does not apply to related linked websites outside the Site, nor to personnel not commissioned by or involved in the management of the Site.

2. Collection, Processing, and Use of Personal Data

When you visit the Site or use the features and services provided by the Site, we will, depending on the nature of the service feature, ask you to provide necessary personal data, and process and use your personal data within that specific purpose; without your written consent, the Site will not use your personal data for other purposes. When you use features such as the service mailbox or questionnaires, the Site will retain the name, email address, contact information, and time of use you provide. During general browsing, the server will automatically record related behavior, including the IP address of your connecting device, time of use, browser used, and browsing and click records, as a reference for improving our services; this record is for internal use and will never be made public. To provide accurate services, we will compile and analyze the collected questionnaire content statistically. The statistical data or descriptive text of the analysis results will be used for internal research, and we may publish statistical data and descriptive text as needed, but this will not involve any specific individual's data.

3. Data Protection

The Site's host is equipped with firewalls, anti-virus systems, and other related information security equipment and necessary security protection measures to protect the Site and your personal data. Strict protection measures are adopted, and only authorized personnel can access your personal data; the relevant handling personnel have signed confidentiality agreements, and anyone who violates the confidentiality obligation will be subject to relevant legal penalties. If it is necessary to commission other units to provide services for business needs, the Site will also strictly require them to comply with confidentiality obligations and take necessary inspection procedures to ensure their compliance.

4. External Links

The Site's pages provide links to other websites, and you may click through to other websites via the links provided by the Site. However, those linked websites are not subject to the Site's privacy protection policy, and you must refer to the privacy protection policy of the linked website.

5. Policy on Sharing Personal Data with Third Parties

The Site will never provide, exchange, rent, or sell any of your personal data to other individuals, groups, private enterprises, or government agencies, except where there is a legal basis or contractual obligation.

The exceptions in the preceding paragraph include but are not limited to:

  1. With your written consent.
  2. As expressly provided by law.
  3. To avoid danger to your life, body, freedom, or property.
  4. Cooperation with government agencies or academic research institutions, where necessary for statistics or academic research based on the public interest, and the data, after processing by the provider or under the disclosure method of the collector, cannot identify a specific individual.
  5. When your behavior on the Site violates the Terms of Service or may damage or impede the rights of the Site or other users or cause harm to any person, and disclosure of your personal data, as analyzed by the Site's management unit, is necessary to identify, contact, or take legal action.
  6. Beneficial to your rights and interests.
  7. When the Site commissions a vendor to assist in collecting, processing, or using your personal data, it will exercise due supervision and management over the outsourced vendor or individual.

6. Use of Cookies

To provide you with the best service, the Site will place and access our cookies on your computer. If you do not wish to accept cookies, you may set the privacy level to high in your browser's settings to reject the writing of cookies, but this may cause certain features of the Site to not function properly.

7. Amendment of the Privacy Protection Policy
